Go & Claim Your £84 Back From Sony

A NeoGAF Forum mod has just got back a partial refund of £84 (€96) from Amazon for his launch 60GB (without return) because Sony has broken EU law with the removal of other OS in the 3.21 firmware update, as you can imagine this is going to lead to a swell of people going back to retailers demanding refunds because even if they care or not about Linux they are likely to get the same refund.

Under Directive 1999/44/EC the good must "be fit for the purpose which the consumer requires them and which was made known to the seller at the time of purchase." As it was known and advertised that the PS3 could run linux at the time of purchase Sony have stolen functionality away.

All the refund costs will have to be claimed back from Sony so this may pressure them into either defending their reasons for its removal in court or bring back the other OS feature.

Which Geo Hotz has apparently done already with his custom firmware. As he wrote on his blog "Note to the people who removed OtherOS, you are potentially turning 100000+ legit users into "hackers." There was a huge(20x) traffic spike to this blog after the announcement of 3.21. If I had ads on this site I guess I'd be thanking you."

I think he's right, the majority of people play nice until they get screwed over.

I would go try for a refund in a heart beat but my console is imported.

This is very interesting, I've got a launch 60gb.

I'm going to watch this unfold and maybe make a claim myself, of course I've had Linux installed on my system from day 1 & I'm now deeply upset that I can't use it anymore :sly:
 
Nice find. I think I may pursue this too. I had wondered if they'd be braking the law in this area........
 
what if you have a replacement from sony, because the first one broke, and then the replacement got the ylod? do i still get the money :P

i got mine at lunch launch, so it's old, plus the shop were i bought it are stupid (all the shops of them) so i don't waste my time and nerves for 93 Euros. (cause i would need to really argue with them, i wait and see, if it becomes common through different shps i try)


To say how resellers want to get your money. a friend of mine bought a ps3 weeks ago, i was with him. And the stupid reseller said he only got one year of warrenty. I started direcly the attack... you stupid moron, learn your damn obligations as a shop. All electronic device in the Eu has 2 years of warrenty. MS stats the same in their warrenty(written), which is plainly wrong (they give 1 year overall warrenty, and 3 years for ROD)
3 years is their business, but 1 year is not applicable.
2 years are mandatory

Exactly which is even better because even if Sony doesnt want to play ball with the law (I can imagine getting money back directly from them would be like getting blood from a stone) the common retailer will not want the hassle of getting involved and might just decide to give you something to keep you happy.

Seeing as most people would have bought their PS3 from a 3rd party retailer its worth a try just firing off an email, you dont really have anything to loose.

Argos state that the EU directive only permits the buyer to lodge a complaint within 2 years, not claim a 2 year warranty (i.e. if a fault occurred within the 12 months, you have 24 months to notify them).

Manufacturer's warranty is 1 year according to Argos, and since my console was purchased December 2008, for the 1 year of the warranty the console worked as advertised.

To be fair, the call centre clerk admitted to not knowing the legislation fully, but was courteous and understood the complaint. He suggested I speak with Sony, as Argos are only obliged to honour the 12 month warranty (according to Argos).

This actually is something I miss. I had YDL installed, and it took ages to get it working properly. It was quite good, and gave me a decent e.mail client (ThunderBird) and FireFox, all from the PS3. As the PS3 browser is unstable at best with limited functionality, I enjoyed having access to FireFox from the same unit :-/
 
Hmm. Why would I want money from Sony. I'd prefer to help my favorite company than hurt them in a way that doesn't even effect me...... I love my ps3 and it was worth every penny. But this isnt a Sony issue "yet" and retailers may make it one becasue everyone wants a piece. All Sony has to do is reactivate it and all claims will be dropped :). making one big waste of time.
 
Does this work on the 80gigs without the PS2 compatibility and in Australia? I dont see why not, the 80gig still had otherOS and its only a different country, has anyone tried?
