I still cant believe its happened

Well the Thurday afternoon before Easter is a day I will never forget. My wife and I were out working doing a small deliver in the Jag, Thought we would have a day not using the Ford Transit van. My wife was driving ( and I dont blame her) she stoped at a stop sign and and thought the road was clear so moved out waiting for the another lane traffic to move so she could pull in, when a old Holden Astra sedan ( Nissian Pulsar ) hit the front of the Jag. The Jag being the size and weight that it is just rocked a little but the Astra span around the front drive shaft was broken in half and the front was total mangled.

Now here's where the real fun starts. The driver of the Astra is an off duty cop and his car is not insurared (Its a right off) we are to blame no problems we are insured (or so we thought). Because we were using the car for buisness use claim declined :eek:

The car is currently at a smash repairs of a good friend. the good news is I have located 90% of the parts required to fix it for a mere cost of $250 , the guy from the smash repairs has told me that what I have already got buying new would cost nearly $2500 so now its just a case off pulling off the old and putting on the new and a new paint it will be on the road soon :)

a point that needs to be relized that if I had done a major mechanical problem it would proably cost probably about the same amout and no insurance ,eg a new V12 jag motor is nearly $10,000

Just goes to show expensive cars are worth it...
And that those older Jags are truely tanks :lol:

I can tell you had we had any thing else the damaged to our would have been more than doubled we you have about 3/4 tonne of plastic and coke cans hit 2 1/2 tonnes off solid steel I 'm know what I would rather be in
 
I don't care if he's a cop or if he's on/off duty, he's still liable. How does being on 'business mileage' make you the only liable party?

we stoped at a stop sign pulled in front of the traffic we should not have been there our fault that fact that he is a cop as nothing to do with it .

the insurance company will not pay out were the car is being used for buisness use they say we never disclosed that we use it as a company vehicle but then the question was never asked.
 
Where are you from? My state, AR, requires at least liability insurance on all vehicles.

And for the vehicle being used for business thing, I should check that out. I've used my truck to make deliveries for my uncle before. If it got wrecked while it was doing that, I would be screwed.

Been there, done that. It was worse though. In our '89 MPV, we were sitting at an intersection, light turned green, we start to move then slam the brakes. A white TV repair delivery Ram van hit us in the front, like against the middle of the front bumper at an angle. We did a 360 in the middle of the street, engine still running(we actually drove to the side of the road)with the front frame slamed against the tire and the hood smashed up and bumper desentegrated. Then I watched as the guy pulled into the Gas station we were near, running over the curb before locking the brakes. He got out, looked at the dent(Rams are stong tankers), scratched his head, and then came strolling over to us. "Are you alright? It wasn't that hard of a hit..." He sounded like a moron, he was a moron, he was reading a map and went through the intersection on a red at about 40 mph. Here's a diagram:

We were on the strait part perpendicular to the main road. We were making a left, and the guy was coming from the left. "G" stands for gas station, were the guy turned in, and where a cop was on the phone when it happened(he didn't hear the hit, or see it cause the gas tanker was parked in the way). The front looked like an off set crash test, hitting the passenger half of the front. Damage was limited to the front, no damage behind the front of the front door. It was totalled though, frame bent and engine twisted, and this happened the morning after my dad finished a tune up on it, it was totally mint condition. I was in the passenger seat, saw the hood go up and all of it. My mom had slight wiplash, me and my brother(he was in the middle seat) had seat belt bruises, no serius injures though. The next night we found the '92 MPV, that's what we got now. We sued the guy and got about $8,000 or so, if that much. And that accident was 8 months after my dad got hit in the same intersection in his RX-7 GSL SE, person running a red slammed the front wheel, if my dad had gone a foot farther it would have been through the door. He was ok though, and fixed the car.

Lots of accidents, none caused by us. My brother had an accident last friday, rear ended a guy after the person in front of the person in front of him missed a turn and locked up the brakes. My brother hit the brakes but it was too late and he hit the guy un front of him. Minimal damage, a bent fender, broken head light and corner light, and cracked bumper. He's fixing it no though.

Im in Western Australia here its is not compulsory to have comprenive insurance but only 3rd property which only covers people and property not cars there is 3 rd party insurance you can have for old cars which covers the cost of repair to the other vehicle but not yours.

as for being used for business use there is only a few insurance company here that will cover cars used as buisness vehicle
 
Drivers these day have been using there polyphony 001's and F/somethingerathers alot in Gt3 and think their own cars are going to fly round a corner and/or stop in an instance, but it won't cause the average motor vehicle is a freight train!

Other words it acn derail or not stop at the station.

Station = Traffic Light, Stop or giveway Sign.

Well - no it's not - important rule of contract law. You MUST read your insurance contract!!!

Two reasons I don't drink and drive -
1. It's dreadfully dangerous.
2. We lease our cars. If I put the big blue super Sube into the scenery after ten beers, I ain't covered. Which means we're making lease payments on a very broken motor vehicle.

I'm sorry to hear about your predicament, Jag_man - another victim of increasingly pedantic insurance companies. If the incident had occured while your wife went to get the milk, there would not have been a problem.

Sadly the insurance companies do this to people and then wonder why people lie about accidents - you've done the right thing and been belted by your insurer as a result.

To the guys who abused the off-duty policeman - that's unfair, they were probably just tootling along minding their own business and suddenly this gorgeous blue Jag was in front of them - we've seen countless tales from both sides of this stories on this site.

I agree it's unfair - but that's insurance for you. The same insurance that covers you if the water comes in through the roof, but not if it comes up through the floor or through the door.

Look at it this way - no-one was hurt - and you can always earn more money.

Hope it's all fixed soon, mate. ;)
 
the lastest news is my friend the smash repairer is happy to slowly work on it for me but if he needs the room ill just bring ti home a short time says im looking about $2500 to fix and paint and is willing to let me pay him off so things will work out

Good - sorry to hear about your troubles, mate. Nothing worse.

If it makes you feel better, I've just seen Gilchrist get 43 off 20 balls, and the Aussies are 0/61 of 5.3 overs (no mistype)
 
dont worry there is always sombody worse off than you ...
while at the smash repairs he had a guy phone he has had 2 cars stollen from him and just got 2001 Holden ute is insurance preium was $6500 a year so he tried to get insurance with another company he had a cover note that ran out on Friday and while out at a party Saturday night the ute got stollen and bably damaged he has no insurance and its just about a right off
 
jag is looking good went there yesterday and it been moved from its sad spot in the corner had it have a littlr bit of chassis straighten (all ok now ) the new front guard is on the bonnet is closing properly they just have to fix the couple of dents in the bonnet, plus theres a couple of new parts I need to get , all up parts have cost me about $400 and smash repairer says about $2500 to finish it
