Alright, here's the story.

My friend made a website. It's about rumours, information, and general fun. It involves, basically, things that have happened, could possibly happen, or possibly have happened regarding friends of his. It's all in good fun and nature, and none of us care, we don't mind poking a bit of fun at ourselves really.

The only people that can access this site are people on the site-creator's contact list, meaning it is strictly friends that view it, and we know them all, as he doesn't have a big contact list.

Now, our school has gotten involved. Let me first, and foremostly, say that this website does not involve the school, teachers from the school, or anything negative against the school what-so-ever. There is no mention of the name of our High School anywhere on the website. They have told him to take down the site, which provides entertainment for us all. We pleaded with our friend to keep it going, as it was doing no harm. He kept it.

The school has now suspended our friend for 4 days, jeapordising his Higher School Certificate year, and denoting him throughout his report. This will be viewed negatively on him later in life.

The school suspended our friend because they claim someone has complained. They say the reason of complaint, is that a person, who was claimed to have been pregnant, when she wasn't, has complained about the website. Now, the person who was claimed to be pregnant was my girlfriend. It was a short-lived bit of fun, provoked when we worded some things incorrectly and basically speculated ourselves that she was. We all laughed, including me girlfriend and I, and I still find it funny in which the way they come up with things like that. So does my girlfriend.

My girlfriend positively did not complain, neither did I or her family, or anyone related to her in any way, shape or form. And since noone else has had this "pregnancy accusation" on my friend's website, they have basically falsely implied that my girlfriend has complained, meaning they have no right to suspend out friend.

Does this seem over-the-top, and unfair to you? And do you think they have any grounds to do this to our friend?

Personally, I think it is a joke. I'm prepared to take it further for our friend, as he's done nothing wrong, nobody has been harmed, and the school can't even access the site thanks to the restrictions that our friend has placed on his site.

If they don't like it, they can simply block it from the school's computers, which is what they do to a lot of websites.
 
Was this site created on a school computer??? Is it used at school, on school computers??? If so, then they can do that. Otherwise it can be taken as something outside of school and can't do anything about it.

Sounds to me that your g/f needs to straighten that sheite out.

That is defniately unfair, and I don't see how the school has the jurisdiction to shut your friend's website down. There's nothing wrong with then site. It's the internet, a free-speech network. Fight it to the death, I say!
 
Drift4eva actually came up with the correct answer. Almost.

The other portion you have to consider is if anyone accessed it from a school computer. If so, someone may have found and read portions of it from the hard drive. In which case someone official likely tracked it down and read it.

You're viewing objectionable material on the schools computer system.

Much like an office, it doesn't matter if it's before or after work hours, viewing anything objectionable (according to office standards) is a dismissal. Flat-out. I've seen it happen before. I've seen instance, where a person was let go, the computer becamce a "hand me down" and the secretary flipped out and threatened a sexual harrasment suit because of what she found. The company was liable, as they hadn't conducted due diligence before handing off the computer.

She basically worked there for about 3 months then walked away with a nice settlement.

So, JimmyN/A, if the site was ever accessed or created from a school system they have the right to pull access to it. There may have been more happening behind the curtains thatn you know. I'd do a bit of searching around and find out the full story first.

If that fails, get the principals e-mail address and sign it up for 3,001 "creative" websites.

I'm joking on that part.

As Der Alta said, this can only be the school's business if the website was accessed via a school computer. If you can prove the website was never accessed using a school computer, you might be able to nullify the suspension. And since you said you know everyone who accessed the website, this might be easier than it seems.
 
Even if the website was accesed from the school, it can't be shut down. It is the resposibility of the school to implement security measures to prevent that from happening and disipline anyone who violates the code. If a student accessed a porn site from the school, I doubt the school would try to shut it down.

In a word, the answer to your question is YES.

that's not as bad as my school. in my BST class, the moron freshmen (the ones who are better off not even being at school) all look at some gross porn on google and yahoo. dont get me wrong...porn can be a good thing. <_<....but this stuff was just messed up.

i should say something....or bring my camera one day :D

I had a similar issue happen to me. My friend Jodie and I were kidding around and she said something (i forget what it was) and I thought she said "I'm pregnant" and I was like "wth? Jody's pregnant?" and she made it clear that she wasn't. so, anywho, for the next couple days (with the same friends) I kept pullin her leg by saying "Jody's pregnant!", but it was only whenever she was around and could A) make fun of me back or B) defend herself. I guess thats not what one of those good twoshoes kids thought. They went to the principle and said that I was starting rumours, and saying shes pregamanant. Long story short, I avoided charges but got suspended for 4 days. Her family was italian too, so as soon as they heard it they were like "Voi testa della merda maledetta dio piccolo li ucciderò!!" or something and I haven't really talked to her since. The moral of the story: be DAMNED carefull as to what and where you say things. It took me 3 more tries to get that one right! :lol::lol::lol::lol:
 
I'm so happy I covered my ass and remained annonomous when I created a school gossip forum. Although it was more of a lets all take the piss out of everyone forum it was good.

Okay you might have some of the strangest friends, I mean I don't find a little bit of fetish *enjoyment* strange I mean we all can be curious but come on, THAT IS JUST OUT OF THIS WORLD *just threw up in my head* :crazy:

It has been accessed by a school's computer, but like I said, there is a simple blocking method. They seem to be refusing to do this. It's almost as if they have it out for my friend. People access inappropriate material all the time at school, and we run off a server that allows the Administrators to see what you're looking at (only the URL, not the webpage itself), they take that URL, check it out, and block it if it's deemed inappropriate. They can't view my friend's website, so I'm actually thinking they might be very curious to know what's on the site.

I still think if the reason that my friend got suspended is that it was accessed at school, I think that's very unfair to him, and he is not the person viewing the website. The school should simply block the site. He should not be liable for creating a website which was viewed at school, yet no action was taken to stop the accessing of the website at school.

It's unfair and wrong. Very wrong.

A friend of mine was looking at car pics, when he came across one with a model doing the whole car - female pose. She was in a Bikini and got caught looking at it. He was suspended for 4 days.

Others would look at The Simpson's pr0n for a laugh.
 
Schools always butt into students personal out of school life, back in my school days a friend of mine got in a fight on a weekend nowhere near the school, the other guys parents told the school and my friend got suspended for a week because of it. What sort of BS is that.

First of all, the website was made purely at home. Secondly, I don't see how it can officially do more harm than good. I mean, yes, they want to know what's on the website, but the pure fact that it has nothing to do with them evens it out. They simply cannot view the website, as they are not friends of our friend, and they aren't on his contact list.
 
God damn, why do 2 kids have to go on a rampage in Colorado and ruin it for the rest of us. :grumpy:
 
That's like when me and 3 friends were throwing snowballs at cars.... at 9 at night. The person we hit told the school and immediately the principal knew who it was. Like WTF! I'm a good kid..., goofy sometimes... but a good all around kid. Don't get me wrong, I like my bit of fun. I mean come on. If that little snowball I lobbed at the Cherokee did any damage... it's his own fault his Jeep made out of paper and beans.
 
I'll host the site.

I'd like to see them try to shut me down.
 
I suggest you write a formal letter to the school asking them to, in print, give teh reasons why the site should be closed. The write a response countering every point they have made.

But get it done well, you don't want this turning into a death circle.

Don't think it'll ever stop, unless I pull it down or the circumstances change.

Perhaps I'll revive it next september. Set up a bogus hotmail and send an e-mail to all my school contacts.

Incredible. I have such a strong distaste for public school administrators and their abuse of power. My old high school was full of these wack-jobs. I think your friend and his parents need to blow the whistle here on this abuse - contact the local newspaper and TV stations. You've got to put a spotlight on the issue of schools thinking they can punish students for their lawful actions, in their private homes, which are not sponsored or otherwise endorsed by the school system.

A similar thing happened back when I was in high school. Three bone-headed freshman cheerleaders took nude pictures of themselves and sent them to their friends. Of course, it took about 1 hour for them to be forwarded to about 50 different people - and the girl's parents. Keep in mind, this all took place within Hotmail - nobody ever tried accessing or bringing the pictures to school. Nevertheless, the school got word and suspended the girls, and tried to do the same to everyone who received the pictures! As you can probably guess, most of us (I received a copy of the email) were not about to get kicked out of school for having naked pictures emailed to us against our will. Parents got involved and upset, and the principle backed down.

The thing was, the principle was looking for any way to get "the popular kids" in trouble. As these girls were cheerleaders, their pictures were forwarded to everyone who knows them and who they are ('popular' kids), so it made it pretty obvious what the principle was actually trying to do. Is there any chance your principle could be using this incident to get back at your social group, friends, or your friend's parents?

So the site was made at home, and did not involve the school in any shape or form?

The school can't do that. Nobody owns the World Wide Web, and anyone can put any site on it.

Seriously - I WILL host it if necessary. Then it would be a site created out of school hours not using school property and hosted on a UK server. The amount of legal legs to stand on they'd have would be none. That said, they don't have any currently either, but it adds an extra shell of protection - and a backup, just in case.


If students are accessing sites in school time which are deemed as "not suitable" then the school is limited only to blocking the site(s) in question or banning anyone found visiting "inappropriate" sites from computer use (at least for the short term). They cannot "shut down the internet". If they cannot block the sites, get decent IT technicians who can actually do their job (like the one at the school I work, who can ban a site from being accessed, campus-wide, within 7 seconds of a child accessing it).

Astonishing.
