wait if the legal limit for drivers under 21 is .02 and you got that same whopping result on your breathilizer isn't that underage drinking. Plus you were at the park when it was closed.

Wow, you catch on quick, don't you?

Here's the deal. He broke the law. The law needs changing. He still broke a law and should be punished. The law still needs changing.

Public intoxication isn't a crime unless you're over the state's legal limit to drive (and, of course, walking around in public), no matter how old you are. SublimeDood says it's .02 for under-21-year-olds so maybe the Pennsylvania state legislature decided for once in its history to be proactive and change the law and I'm wrong.

Keep in mind people - intoxication is defined as an abnormal state essentially a poisioning and one beer isn't going to allow you to reach that state if you're of any sort of actual age.

"Oh, a whooping .02!" Hey, guess what here chuckles, .000000000001 is still illegal, just the same as .02.
Usually, there's a margin of error in a Breathalyzer test, so .02 is fairly low, if not close to the normal alcohol level that naturally occurs in one's body.

He's not on probation, he's an 18-year-old just like most of us were at one point. You can't fool me, a lot of us turned 18 and had a beer or two. That punk cop was doing his job, but not exactly saving the world from the terror that was SublimeDood10. He wasn't in a car, but he was loitering in a public park with a cigarette in his hand.

I can't believe that mother****er would actually put you in the back of a cop car for petty civil offense...(unless you're leaving out a part of the story). Get an attorney if the fine/mark on your record is going to harm you in you municipality. Utter bull****.

Either that, dress nice, show up in court, apologize or something stupid like that, and maybe they'll dismiss the charges.

He claimed he put me in the back of the car to check if anybody else was in the park with me.

Our family has a very good lawyer, and we're going to take it to court and either get them to totally dismiss it, or at least get it down to community service. It's my first ever encounter with police in my life, so my record is completely clean.

where do you live ? Remind me not to go there. No joke but in the age of lawers and lawsuits that we are in now the poor cop was dammed if he did and fired /sued/screwed if he did not. He cant get in trouble for doing his job but he can be totaly screwed for cutting you a break . The law sucks but its the law. a good lawyer will get any charges droped . The fine though they will be expecting to be paid. when I was 18 the drinking age was 18 since then alot of drunk and crazy 18 year olds convinced the states to raise it back to twenty one..blame them.

Jesus, you're an ass. The cop busted you for doing something illegal you come here and say that you did something illegal, but you're going to sue anyway?

And here's some facts, chuckles:
http://www.pa-drunkdrivinglawyer.com/underage-drinking.htm

"In Pennsylvania, it is illegal for anyone under the age of 21 to drink alcohol and for anyone over the age of 21 to provide alcohol to a minor. The penalty for underage drinking is a fine of up to $500.00 and driver's license suspension. The minimum fine for a first offense of providing alcohol to minors is $1,000.00."

If you drink alcohol while under the age of 21, you're breaking the law, regardless of what any breathalizer read.

359..you said he's an Idiot ? Going to lawyer to protect your rights is not the same a suing . Grow the %$#@ up. Everyone deserves to protect themselves. hiring a lawyer when you are charged with a crime is the smartest thing you can do, after all its only going to affect you possibily for the rest of your life. Maybe when you are old enough to be off the tit you will realise that. I hope one day the words you are spewing out in this thread do not come around to bite you in the ass when you make a mistake. When you do be sure to get a lawyer moron.

18 year old adults drinking?

Jesus, the US must be one crazy place, filled with drunks.

Are you so ****ing thick that you can't realize that I have said this numerous times: I am aware that I broke the law.

I know that it is illegal to drink under 21. I'm not trying to claim that anything I did was legal. At the same time, I am trying to show people that not all 18 year olds who drink are going to get completely hammered and endanger those around them. In any other country other than America, 18 year olds are responsible enough to drink, yet for some magical reason just because I was born in America, I'm not reponsible enough to enjoy a beer. Either change the draft age to 21, or change the drinking age to 18. If I'm old enough to be able to be drafted into the army by my country, I think I am also old enough to sit down at a bar and order a beer.

As for you calling me an idiot for hiring a lawyer, I am simply protecting my rights, just as ledhed said. If I have the resources to get a lawyer to help protect me, I am sure as hell going to do it. Also, who said I was going to sue? You'd make a great cop, you should look into it. This state needs more brainless, rule-crazy, ass****s like you to keep all of us horrible kids in line. I probably would have ended up face-down in some gutter, since you said I was so intoxicated from that one beer. Thank God that cop came and saved my life.

Isn't that the drinking age in GB?

My teacher said that Italy's drinking age is like 13. I don't know if she was full of **** or if it's true.

Thats whats great about Europe, from an early age you are taught to respect alchohol and naked people are on bill boards. two things the US could take a lesson on. a person old enough and responsible enough to die for his country should be able to choose to drink beer or WHATEVER ..cripes ..heres a friggin M1a1 tank and some cruise missles but lay off the beer when your done destroying that army...SOUNDS RETARDED DONT IT ? I can hold the life of my squad and the enemy slodiers in the palm of my hand but I CANT HAVE A FRIGGIN BEER ??????? F^&kin moronic law. but then again we thought PROHIBITION was a great Idea and in some states a hum jobs still Illegal and michael moore makes money at his job...so wattayaexpect.....cripes ...I need a valium.

I used to have a couple good friends. Now they just get drunk all the time and ignore me and my sober friends. They suck.

What rights were violated? Um, lets see hereNONE.....

He admits to breaking the law and then wants to go to court to try and say the cop did something against him that wasn't allowed? Screw that. That's just plain ignorance. I never said he never needed a lawyer, my problem is with him trying to fight his arrest.

That's the mentality right there. And the exact reason why you're just going to continue to break the law. 👎 "Oh, well, THEY can do it, so I should be able to too!"

Hey, guess what there chuckles, most kids in Europe are also brought up to respect alcohol by their parents. Different culture, different laws.

And no your draft age has zero relation to your drinking age, so you can quickly cut that arguement. Just because you're mature enough at 18 to hold a gun doesn't make the general 18yo public mature enough to handle alcohol, as is QUITE evident with any college campus.

As for you calling me an idiot for hiring a lawyer, I am simply protecting my rights, just as ledhed said. No, I'm calling you an ass for trying to say the cop did anything wrong and fight the fine/record you were given. If you want to sit here and admit that you know you were doing something illegal, then don't argue the punishment you're given for breaking said law.

You'd rather give 18 year olds deadly weapons than give us alcohol?

I don't know about you, but I see something wrong with that picture.

I love that episode of the Simpsons where the ticket guy at Euro Itchy and Scratchy Land begs for business because his last paycheck bounced and his "children need wine".

Yet we, in Britain, have a higher number of underage drinkers (proportionally) than the USA despite our legal drinking age being 3 years lower... And let's not even begin to mention that most town centres are no-go areas at 11.30pm (chucking out time) on a Friday/Saturday. Or football riots. We don't allow alcohol into our sports stadia at all...

In the UK, a child is allowed to drink at home with parental supervision at the age of 5 (and that's really a law. Seriously). It used to be the case, as in France, that most families had a meal together once a day with wine accompanying it, but it's sadly a dying trend. At 16 you are allowed alcohol in pubs with parental supervision. At 18 you can buy your own.

Are you dense or just dumb? Do you think the Army just goes "Here, have an AK-47, do whatever the hell you want with it..." No, they teach a little thing called respect and educate them on when and when not to use a weapon.

Every country is going to have those who will disregard the law, but I'm sure those who do obey the law and act in a mature manner handle their alcohol better then those in America.

It's illegal to bring your own alcohol in most public places in the US; in Florida you can get arrested for bringing a flask (ah, but it's fun!) into a concert or sporting event. It usually depends on the state/city laws, or the venue.

On the other hand, I'massuming you can purchase an "adult libation " at a football match in the UK, right? Or get hammered at the stands at Silverstone? Have a pint in a plastic cup at concert in Wembley Stadium, right?

So why not educate them on drinking at the same time? Teaching them respect and when and when not to drink.

Because not everyone goes into the army, nor is it the army's job to deal with alcohol :dunce:

What high school and health class hasn't tried to teach kids about handling alcohol? Obviously it is not fool proof, but they still try.

No - although I'm not totally sure about Silverstone.

Alcohol is prohibited at football matches. The best you'll get is a chicken & mushroom pie and a cup of Bovril. Frankly, if you need to get pissed to enjoy a football match, you're probably watching Sheffield Wednesday.
