Ninth Circuit Allows Xbox 360 Lawsuit to Move Forward

Remember the scratched disks on your new 360 that you bought in 2007? Wanted to sue then?

A lawsuit out of California that has been filed in 2007 has just been allowed by the 9th Circuit Court of Appeals to move forward after it was dismissed by the District Court. The appeals court ruled today that the District Court judge misapplied a law that wrongly set this case back. (the video linked below will describe it in detail.

Now what does that have to do with the scratched disks? In 2007 when Microsoft was looking into cost cutting measures for the 360, they removed the rubber gasket in the optical drive. As a result, the plaintiffs claim, the disks vibrated violently and with one touch of the console, the disk gets scratched beyond repair.

Didn't I read somewhere that this also happened with launch original Xbox's? MS seemed to always have issues with their drives due to cutting corners.

As history has shown the outcome of this lawsuit, if won, will likely result is some free games to download which is little compensation as they will probably be given at minimal cost to Microsoft. It's hardly like they are going to give everyone new 360's.... which they already had to do with the RROD.

Sony really should have compensated for the PS3 YLOD issue but pretty much never admitted any fault despite there being a clear design issue with the launch PS3's.
