Well, the UN recognize a war-crimes tribunal in any nation with a death penalty. However, America hasn't exactly given a damn about what the UN thinks, anyhow.
Iraq doesn't even have a court system, let alone a constitution, so drawing up laws to punish thier former leader would take a good deal of time. And what would they charge him with? That has to be decided...some war-crimes are hard to punish; when war is declared, and conventions have been followed, then it's hard to criminalize everything he's done.
However, there are certain atrocities like the use and testing of chemical weapons on non-Baathist, non-Sunni Kurdistans that are very well documented. There are many that still recall what had happened, many survivors and even eyewistesses of the weapons. Many have survived the effects, and are in terrible shape.
And war-crime trials take a very long time. Everyone has their say; don't expect much in the way of OJ Simpson-like excitement. Slobodan Milosovich has been on trial for about 2 years now, and the trial doesn't appear to ending any time soon...
Forget the trial, make Saddam deal with the same chemical warfare methods the Kurds had to deal with 15 years ago. That should be punshiment enough.
