GTA SA ESRB rating revoked

Here is the long in-deph story.----------------SAN FRANCISCO(AP) The video game industry on Wednesday changed to adults-only the rating of "Grand Theft Auto: San Andreas," a best-selling game in which explicit sexual content can be unlocked with an Internet download.

The decision followed intense pressure from politicians and media watch groups, and retailers reacted swiftly _ Wal-Mart Stores Inc., Target Corp. and Best Buy Co. said they would immediately pull all copies from their store shelves nationwide.

The game's producer, Rockstar Games, said it stopped making the current version and would provide new labels to any retailer willing to keep selling the games, which had been rated "M" for mature. The company also will offer a downloadable patch to fix the sex issue in PC versions, and is working on a new, more secure version, to be rated "M."

Rockstar's parent company, New York-based Take Two Interactive Software Inc., also admitted for the first time that the sex scenes had been built into the retail version of that game _ not just the PC version but also those written for Xbox and PlayStation2 consoles.

Company officials had previously suggested that a modification created by outsiders added the scenes.

Take-Two spokesman Jim Ankner acknowledged in an Associated Press interview that the questioned scenes were created by Rockstar programmers. "The editing and finalization of any game is a complicated task and it's not uncommon for unused and unfinished content to remain on the disc," he said.

In a statement, the president of the Entertainment Software Rating Board said the sex scenes were programmed by Rockstar "to be inaccessible to the player."

But ESRB chief Patricia Vance also acknowledged that the "credibility and utility" of the industry-run board's initial "M" rating had been "seriously undermined."

Many retailers sell "M" rated games, which "may be suitable for persons ages 17 and older," according to the Entertainment Software Rating Board, but won't sell "AO"-labeled games at all."Grand Theft Auto: San Andreas" was last year's top console game, selling more than 5.1 million copies in the U.S. after its October release, according to market analyst NPD Group. Xbox and PC versions were released last month.

Take-Two said net sales could drop by more than $50 million this quarter, and lowered its financial expectations for the year to set aside funds for returns of the games. Guidance was reduced to $1.05 to $1.12 per share on $1.26 billion to $1.31 billion in sales from a prior estimate of $1.40 to $1.47 per share and sales of $1.3 billion to $1.35 billion.

Shares of Take-Two rose 12 cents to close at $27.07 on the Nasdaq, but later dropped $1.81, or 6.7 percent, to $25.26 in after-hours activity after falling more than 11 percent when the decision was announced. The stock has traded between $19.26 and $29.60 over the past year.

The rating change is vindication for Patrick Wildenbourg, the Dutch programmer who developed the "hot coffee" modification and made downloads freely available on the Internet. Wildenbourg had told the AP that his "mod" merely allowed the user to gain access to pre-existing content in game.

Such "mods" are wildly popular among the hardcore gaming community, and have been shown to extend the retail longevity of games like "Half-Life," which is still sold years after its first release because of a popular "Counter-Strike" mod that allows for detailed counter-terrorist shoot'em-up action.

Take-Two president Paul Eibeler said in a statement that "the decision to re-rate a game based on an unauthorized third party modification presents a new challenge for parents, the interactive entertainment industry and anyone who distributes or consumes digital content."

The developments did little to appease Sen. Hilary Rodham Clinton, D-New York, who applauded the ESRB investigation but remained disturbed that the sex content appeared on store shelves in the first place.

"Apparently the sexual material was embedded in the game. The company admitted that," Clinton said. "But the fact remains that the company gamed the ratings system."
Clinton has asked the Federal Trade Commission to investigate, and said the ESRB must do more to police content.

"I think that the rating board has to be vigilant and really make sure that it's as thorough as it can be and not just take the game makers' word as to what's on there," Clinton said.

Best Buy echoed that, saying it hopes its decision to stop selling the game will "send a strong message to game developers encouraging full cooperation with the ESRB."

The Parents Television Council, one of several media watchdogs that have criticized Rockstar and the ESRB, called on the game publisher to voluntarily recall the game and offer refunds to purchasers. Instead, Rockstar has agreed to exchange unsold inventory with new, "M" rated versions that "have the hidden content removed," the ESRB said.

"I tip my cap to that first step of showing responsibility," said Tim Winter, the council's executive director. "Phase two needs to be absolutely getting to the bottom of this coding issue. How did it get into that game? How did it get past the ratings board?"
 
This some some big bull****. 98% of the people who own the game already don't even know how to get it and 88% probably have no clue its in there already.

I hope Clinton doesn't run for President. Her husband ****ed up, and if she makes it, kiss everything that makes kids relaxed goodbye.
 
yeah, this is bull****. And Clinton is wanting it to be illegal to sell M rated video games to 17 and under (or is 18, Im not sure) But if this passes, then the gaming industry could lose a lot of money over a few political arseholes. All of this becuase of a sex scene in a game, that could have easily passed for an R rated movie. If you are gonna ban M rated video games being sold to minors, shouldn't you go to R rated movies as well? This is a great example of the government stepping in where they aren't needed or wanted. But this nation is a nation of fear, so all of us who are still under 17 or 18, stock up now, (including me) Cause its gonna be a ****ing pain to buy video games from now on if you aren't 17 or 18.
 
Well, Mature rating means anyone under 17 isn't supposed to get it alone. If the game is sold to them with no parental guidance, it is illegal, but I get what you're saying.

Hey Hilary, why don't you just go ban Flatout or Burnout or whatever racing game. I mean, sooner or later, some kid is going to go crash into a bunch of cars or whatever! :dunce:

Wow.. has that ever happened before? The ESRB revoking a rating? Take-Two's in some deep poodoo for sure.. I believe there are pretty hefty fines associated with not divulging information about the game that could affect the rating.

And I believe this is the first time a console game has ever been rated A-O (at least since the ESRB was established).

Personally, I think they need to be a bit more liberal with the use of that rating.. parents might get it through their skulls that video games aren't just for kids anymore if they start seeing more games rated A-O.

What about Leisure Suit Larry and the guy game (wacth GGW instead to those whoever thought of it)?

Hell, I mean, why is this such a big damn deal? God of War has nudity, sex scene (you can't see it, but good grief you can hear it), and it shows way more violence than SA ever has.
But I wouldn't doubt, sooner or later, The idiots in charge of us will go after it.

There's no fines at all, the ESRB isn't government regulated, and neither are movie ratings.


And I believe this is the first time a console game has ever been rated A-O (at least since the ESRB was established).

Politicians seem to think all video games are made for kids-- If 8 year old Tommy is playing GTA-- his parents should be in jail.

You have to download a patch/mod to view this thing-- probably easier to find a real sex vid clip then a pixelated one....

I'm guessing its probably associated with the dates...

Now... does anyone have a link to a clip of this?? I'm on PS2 ;)

DOA had a little trick you could do to remove all tops. you had to like beat it 14 times or something. And Fight For NY had no pics. which was a shame because Carmen Elektra's in that game. I dont think DOA Xtremem Beach volleyball has AO rating.Ive only seen it as "M" I would search to make sure, but you know.. Im at work... and that'd be pretty bad.

It won't thank goodness. We don't seem to be so terrified of SEX in the UK as some are in the US. Sure we have a few but generally we only get problems concerning the violence in games such as the Manhunt fiasco a year or so ago.
But we don't have High Street stores that refuse to stock mature video games like Wal-Mart for example. Do they even sell 18 rated DVD'S?
And that DOA: Volleyball game got a 11+ age rating in Europe!

PS. On Amazon.com (US) DOA: Extreme Volleyball is rated "M". Strange.....

Clinton is running for the Democratic presidential nominee. She is trying to appeal to "middle America" and moving towards the center from the left. How can a housewife or a school teacher vote against Clinton when she advocated to "clean" up the videogame industry?

It's a ploy and she couldn't care less about Hot Coffee.
 
With a quick search on ign.com for AO rated games on consoles there is Leisure Suit Larry (but the US will never see this version except on PC) and now GTA:SA, and the PC has quite a list of its AO games. I find the whole thing pointless of giving the game a AO rating NOW. On a console one would have to go through a lot to access the content, on PC it's a quick download for it. But if you play the game as intended there is NO WAY the "hot coffee" mod could be done. After reading the IGN interview done with a R* rep. he said the game was sold with the content "inaccessible" to make the M rating. I'm sure if it was done with all intact it would have gotten the AO it received now. This can't be the only game to have this happen to, this kind of mod can be done to any game, it's that it's easiest to do on PC versions. So if GTA gets rerated to AO, then the ESRB needs to go and rerate AO all games that this is possible to happen. I never did get to play GTA:SA a lot (my friend be hooking up rides a lot and doing cheats) so looks like I'm getting a "reworked" version of the game. I'm still confused as to why it took so long for something like this to happen in the gaming community (or why it did at all). I think that GTA is the most controversial game out with all the violence it has (which is nothing new) and the inclusion of sex (which it appeared on the latest gen. of consoles) but to have the ESRB do what it did seems like someone has an agenda. Who knows how many politicians are enjoying themselves with this mod and being hypocritical of the situation.
 
Who cares R* will profit from this, the demand for the game will sky rocket that's why they're doing it now and not in the beginning. They just want to sell more copies of SA before they move on and it's a smart move on their part.

But think about it? Are they really going to make money? Or are they going to lose money?

Gamestores usually ignore about giving info on Mature, but when it comes to AO, they usually always tell. Not to mention, the parent may ask what AO means.
Plus, the gamestores might not sell if a child is along as they think the child will get the game and that just defeats the whole purpose. Then, R* start losing money in illegal downloads.

This is more of bad profit than good.
 
If anyone actually READ the articles, GTA:SA has been pulled off the shelves(you can't even get it online, i.e. EB, Best Buy, etc.) and the production of GTA:SA has STOPPED. The retailers have the option to sell the GTA games they have in stock now with a AO sticker on it (which I doubt will happen) or wait until GTA:SA gets released with the "hot coffee" taken out of it and will be rated M. So the sales shouldn't change because the rating won't change after all is said and done.
 
I'm still not aware of why the console version would get taken off the shelf anyway, anyone that desperate to unlock pixels and polygons of boobies on their xbox/PS2 needs a SERIOUS life. Plus, half the people weren't even aware of it until now and everyone's going to go out and try it.
 
Rockstar has projected a pretty big loss for pulling it. partly becuase not many retailers will care AO games. Theres even talk of EB games and Gamestop not carrying it.
 
All I can say is that I don't understand this move by Rockstar. Seems a bit foolish to me, it's obvious they're going make a big loss...
