I suck!!!!!

Ok, this morning on my way to work i rear ended someone.

The Story:

Driving down I-44 i noticed traffic slowing in front of me, so i slowed. We finally came to a stop.....then we move at about 2-5 MPH. I'm passing a Dealer's only auction that had this wrecked STi that i've had my eye on for while and i'm triing to find it as we slowly move by the lot. Well i quicly notice that the car in front of me stops and i slam on the brakes and stop about 2 feet behind her. Kinda close.... Well, during my hard braking a empty water bottle i had came from the backseat and went under my seat. It rolled right up under my clutch and got wedged. At a complete stop 2 feet away from this Toyota Avalon let the clutch out to get the bottle out............but i had just put it in first gear. The car jumped forward and bumped the car in front of me.....
The lady had alot of damage on her car before i ever hit it. Neither car was damaged due to this tiny impact. She still wanted to swap info so i did. She later admitted that the damage was already there, and "don't worry about it" "I'm in the clear" I thought. I just got a call from insurance company.......she filed a claim, and wants here whole bumper replaced. This ***** is not getting a penny out of me now!!!!!!!! IT'S ON!! What should i do?
I already have a guy coming to see my car and investigate but i screwed up not having the police come out. But i figured since we aren't hurt and the cars are fine why bother.
 
Well, don't hesitate to tell your insurance company the whole deal, especially that she admitted prior damage. Since the claim will be coming back on them, they'll pursue it aggressively. The one thing they'll want to do is get their adjuster out to look at her car and yours ASAP. He should be able to see just how (un)fresh the damage is.

I've told the story to my insurance and they said they will take care of it. I will not be paying for anything that she can't prove 100%. Which means she will proably get nothing. 👍
 
go Rex! i hate conniving people. is it illegal to make a false claim? isn't that like fraud or something? whatever the case, good luck to you, rexman.

Keep in mind we live in a world full of idiots. Now if he rear ended her in an Abrams Tank then I could see how it would do that much damage so slowly, but a regular car - :lol:.

She shouldn't get a penny. Fight on. If there was already damage there you didn't cause, you shouldn't pay.

I bet she forgot to get the last person who hit her to pay for it, so she just waited until the day someone else got her to pay for it.

And it was you. Her fault, man. Fight it all the way.
 
good luck, the truth shall be found, there is now way she can get away with it, as they will see its impossible for you to cause so much damage, based on your damage toyour car.

yeah i caught that joke from there. it's not halarious, but good enough for a grin.

rex, are you gonna have to go to court or something if she doesn't drop it?
 
Whoever you rear ended is clearly a moron. She should have realised that with little to absolutely no damage done to your car, her heavily damaged back end would look very odd.

You should be easily able to defeat her claim. And isn't she commiting insurance fraud by doing this?

The lady was about mid 30's (i'm 22) She said don't worry about it so i went on my way. I'm sure she called her husband or talk to someone that was like, "you can get your whole bumper repaired if you turn that in." Now this chick is gonna get it. My guys getting her on fraud.
