I recieved this via email (with a @yahoo.com address) and I received a phone call earlier, but I wasnt there so my room mate took a message from a guy that sounded old. This is what , supposedly, the same guy emailed me:
"Jon Fuller, I am Brian Deegan's father and I called today to let you know that the term "Metal Mulisha " is trademarked and you can only use it with permission and after a written contract to purchase the rights to do it. As I informed the guy who answered the phone when I called you was that the Metal Mulisha site needs to be removed immediately. Thanks for your interest in the metal mulisha but sites like this are trademarked and must be authorized by us. Thanks ! John Deegan. If the website is gone-fine. If not you will hear from our attorney."

Might want to email him back, asking to call again and verify who exactly he is. Do you know any "John Deegen"? Is he part of the band or what? :odd:
 
The Metal Mulisha is a dirtbike group (as seen in the XGames). Go to www.metalmulisha.com to check them out.
The person who emailed me claims to be John Deegan (who is Brian Deegans father (Brian Deegan is the guy who created the real Metal Mulisha)). And I emailed him back with no response yet.
 
Hmm. Maybe he thinks that you're claiming that your little group there is the Metal Mulisha.

You should explain exactly what "Metal Mulisha Central" is, and then maybe he'd understand. I dont know what it is either, so if you mind elaborating here, that'd be nice, too. :p
 
Just change the name to MMC
or just give the site a new name
and, seriously, would he email you from YAHOO.COM if he was the founder of the group.. Wouldn't he have some kinda webmaster privilage that would allow him to send an email from www.metalmulisha.com?

Thats my point. They do have an @metalmulisha.com email account, so i would've figured he would use it.

And OUR metal mulisha has nothing to do with theirs. Sure we ride dirtbikes as well as they do, but we came up with the name without even knowing them. If you want to learn more about OUR metal mulisha then click Stories and read the Mulisha Story.
 
Yes, but you dont understand. Their name is copyrighted, meaning Noone else can use it except them. If you dont change it, and they really DO find out about it (if they havent already), they can sue you for as much as they want. Be careful, man.
 
Yes, Acid C has a point. You can't go using the same name as someone who's already trademarked it unless you and the other party can agree that there is no cross-over betwen your business interests. The only example of this that comes to mind at the moment is Williams, with the F1 team and the Pinball game manufacturer.

Oh, and steer clear of "MMC" as well, since that is pretty much 'owned' by the Microsoft Management Console, and we all know how litigious they can be!

If in fact it was a authentic e-mail, then i would change the name as soon as possible. I'd rather do that for free than have to pay thousands of dollars to change it...
 
If your a minor, I have a hard time believing they could do anything serious, other than shut down your site until you changed the name. JMO.

Didnt iR have this same dilema a while back?
 
Well I talked 1 on 1 with the lawyer finally. It appears, that I am not allowed to use Mulisha or Metal Mulisha. Any suggestions for a site name? (Title Here Central) (i.e. Mulisha Central) but I dont want to change the spelling of the Mulisha, so It will no longer me something about the Militia, Malisha, etc.
 
Why don't you just come up with a creative name that nobody's using?
 
Well the Metal Melita is a Metallica song as well and we know about Metallica and copyright
 
I may be the only one thinking this, but I'll say it anyway, the lawyer comes off like a smug jerk.
 
I am aware of that, but it seems more sensitivity could have been used. But, ok.
 
Yeah. After he got what he wanted. I would've researched it and made sure you hadn't come up with it first and made it hard for him.

That I find hard to believe, considering the misspelling of the second word and everything. Seems a little too coincidental to me.

That being said, it dosen't cost you anything to wait and see if you hear from their attorney. If this is legitamate, they'll send you a paper letter formally stating what this guy already said. They can't automatically sue you without giving you formal notice. If/when that letter comes, simply cease and desist to infringe their copyright, by changing your name. Send them back a paper letter confirming that you have done so. End of problem. If it doesn't come, you know it was a hoax.
