Noticed Ferrari and Porsche in the Car List

^ exact-a-mundo! we should all know by now the only reason Porsche and Ferrari aren't in the game already was EA's license...

i don't forsee there being any restrictions on PD modelling cars prior to expiry either... nothing could prevent them from doing that... the prevention would be releasing the cars into the marketplace in a playable format. If the restriction was super tight, they would be already being sued by EA for the inclusion of the cars in the GTP Pal video.
 
I can't see any problems in them modelling the cars now either, technically it's illegal because they are using Ferrari's image without a license but the reality of it is, no one outsidePD would know and no one would really care exept maybe EA nd Microsoft who would only care about such things to try and damage PD and Sony. You see people making cars in games like NFS without a license and no one bats an eyelid so it's just one of thoes things.
 
hmmm... just had another thought about this... wondered if PD had to get some sort of license or authorization to include the Ferraris and Porsches in the PAL vid??? Most likely the answer would be yes (seeing as they vehicles are featured prominently and the badges clearly shown)... which could also demonstrate that PD have working agreements with these co's now, which may lead one to think that licensing is the next step.

I put Ferrari and Porsche on the list merely because I think it'd be dumb to have them in the GT4P video so much if they weren't at least being CONSIDERED for the game...
 
Yeah they can make the cars for the game as far in advance as they like. As long as they don't release it before the current license expires. Rockstar worked on the X-box version of GTA3 and Vice City while their contract with Sony to keep the games exclusives, was still valid. So PD could have the Ferraris and Porsches done and running in-game! And just waiting for that old license to keel over! And while they wait they can add more cars from other manufactures and play test the **** outta the game to iron it out perfectly. Hell they could have someone in their office with 100% completion of the game to make sure glitches aren't there before the game is even out yet!
 
Theres a difference between rockstar making GTA3 well in advance of the contract with Sony running out to PD making models of Ferrari's before that contract runs out. GTA3 is a game, a Ferrari is a car with a unique shap protected by image copyright laws. What that means (most cars are protected by this law) is that no one else can make an identical car be it a 3d model or a real car without the maker of that cars permission. So if they are making models of Ferrari's to put in the game it's not legal but as I said, no-one outside PD would know anyway and it's not a major crime if they did get caught as long as they arn't profiting from it, so they probably have modelled several Ferrari's.
 
Even if they haven't modelled a Ferrari yet, it's almost a guarantee that they have collected data and photos of all those Porsches and Ferraris they tested. It would not be like PD to pass up a chance to get valuable information on cars that they would like to include. And it's not like EA will send a squad of lawyers to PD's offices for taking pictures of a car. So even if they end up not being included in GT4, they can be quickly added in, say, an expansion pack.

You don't need a license to display an image of a privately owned vehicle, it wasn't used for adertising or anything commercial, it was just there.

There's no difference between modelling a Ferrari and producing a game, intellectual property is intellectual property, if someone came out with GTA: San Andreas tomorrow and it bore a striking resemblance to the Rockstar title that's in the works, you think they wouldn't be sending lawyers in? Copyrights are copyrights, trademarks are trademarks, intellectual property is intellectual property and contracts are contracts. The thing is we don't know just what exactly was in that contract.

Can we please stop running in circles? Please? Really. We've been throwing the same points and counter points out for so long now. We may as well stop rewriting this crap and just quote ourselves from other threads, it'd be a lot quicker.
 
In my opinion PD are now sitting in their office and having a good time racing Ferraris and Porsches on the Ring, but that is my opinion since PD took all the data of the cars in the videos they might have aswell modeled them in the game. And the reason that the game is being released in November and not October or September, is simply because it will be illegal for PD to just release GT4 with Ferrari and Porshce in it before the license with EA and both car companies run out, for what they WILL get sued by EA. So you see my point, PD already has the two car brands prepared and as soon as the contract runs out, it will be legal for them to release the game (meaning that both car companies have already agreed to the apearance of their cars in GT4). Otherwise if F and P were not features in the game for sure, i think that we would've had the game by summer, and there woulden't have been so much controversy about the release data and delay of the game. I think that F and P is the main reason GT4 is pushed back so far.

P.S. sorry for my spelling at times, i'm russian and english is nearly my second language.

So... it's just that i hope there will be Ferraris and Porsches in GT4 - though i dont particulary like them too much...
Seeing them in vids tells something....
but... i remember some Renault Meganes and VW Golfs in vids in GT3 (yeah the ending in arcade mode) and they werent in game...

Yea i know it is something else then F and P in GT4 'maging of' or 'teaser' in Prologue but y know...

for some interesting thoughts towards the P&F debate... you'll see a few people adament that they won't be in... but even people who are sceptical like me have to see some logic and foundation in these arguments for inclusion. :sly:

BTW, the EA license is up in November... a Ferrari rep has declared their desire to be in GT... PD delayed the release to November... Ferraris and Porsches have been seen been driven by PD staff @ a PD event, and have now appeared in an official GT product... you do the math. 👍

Many people are speculating about this but in the europe version of GT4:P on the bonus DVD Polythony digital and Sony were on there testing numerous Ferrari's and Porsches. This is a strong indication that they are in the game but still no comformation!!!Where is it?
 
PD were not testing thoes cars, they simpley filmed a staff day out. There is a lot pointing to a possible inclusion of Ferrari and Porsche though, check the link Phantasm posted for more indepth discussions on it.
 
call me over-optimistic, but i think GT4 will have Porshe, Ferrari and Lambourgini and here is why

KY was quoted somewhere as saying he would be willing to delay GT4 just for them
EA's License expires in early November
GT is released mid-late November
PD has been testing all three openly for the past few months
if PD had announced that they would be in, EA would probably opt to re-license both brands before GT4 is released
 
I agree with all you say about why Porsche and Ferrari might be in, although I'm a little less optomistic here, but PD has not been testing Ferrari's and Porshes openly, a couple have been spotted at esting days but NONE to my knowledge have been seen actually being tested.

Do you think EA dont Know what PD would like, if they dont announce it.
Im sure EA have been manouvering quite hard to secure a renewed Exclusivity license, However Im sure the manufacturers, who are now a little more clued up, and understand better, the matter of licensing issues for games and the benefits of wider brand use would bring.

dunno if someone mentioned it but even GTR (PC, Xbox) will feature Ferraris, Porsches and Lambos...

Guess teh license must not be so hard to acquire now... I think Kazu will keep telling no Ferrari and Porsche but in the end it will be there...

Same with Lambo and Porsche. And I'm sure they all realise that GT reaches far more people than NFS. But I think Porsche and Ferrari have a far better chance of being in the game. And yes it's true nobody saw PD test those cars, but nobody saw PD at vegas, or Nurburgring, or hardly any other palces they where at so who is to say that they didn't test Porsches and Ferraris?

Vegas is an imaginary track and I believe PD was seen testing at NN. Some of those other courses are also imaginary.

I'm glad that there is atleast cars in GT4 ;)

I don't really care about Ferrari or Porsche either. Theres only a few cars they have made that I like.

Well the simple answer for your question would be that the car makes Ferrari and Porsche are in the list because they have been seeing tested by PD Staff and therefore fall in that category of red or green dont really remember which, but yes thats why there on the list and I think somewhere in that huge list theres a picture of the Porsches and Ferraris. Well good luck in GTP. Hope no one tries to pick on you, you should know there tends to be some PRICKS here in GTP.
