Ford's New Mustang Sued for Infringing Patent on User Configurable Multi-Color Instrument Panel.

Beverly Hills, CA (PRWEB) December 8, 2004 -- Frank Weyer, a patent attorney and inventor of U.S. Patent No. 5,975,728 issued on Nov. 2, 1999 announced today that he has sued Ford Motor Company for patent infringement. According to the complaint filed in the U.S. District Court for the Central District of California as Civil Action No. 04-08630 CBM (SHx), the "MyColor" TM option that is part of the interior upgrade package on the highly touted 2005 Ford Mustang infringes Mr. Weyer's patent for "Method and Apparatus for Providing User Selectable Multi-Color Instrument Panel Illumination." Mr. Weyer conceived of his invention while a graduate student at M.I.T. After the U.S. Patent Office granted the patent in 1999, Mr. Weyer sent a letter to Ford and other automobile manufacturers offering to license his invention. Ford did not respond.

Now, five years later, the new Ford Mustang features a user color-changeable instrument panel lighting system Ford calls "MyColor" that Mr. Weyer claims infringes his patent. Mr. Weyer is seeking damages and an injunction that would prevent Ford from selling or delivering any new Mustangs with the "MyColor" option. Mr. Weyer, filed the complaint on October 19, 2004. Prior to formally serving the complaint, Mr. Weyer contacted Ford, and offered to reach a cooperative resolution. Ford initially requested additional time to respond, which Mr. Weyer granted. After two months without a substantive response from Ford, according to court rules, Mr. Weyer was required to formally serve Ford with the complaint.

Mr. Weyer has informed Ford's in-house counsel that he is preparing a preliminary injunction motion that he intends to file in the near future. The preliminary injunction, if granted, would immediately bar Ford from offering for sale, selling, manufacturing or delivering any 2005 Mustangs with the infringing MyColor feature. That could prove to be a disappointment for Ford, which has launched a massive media push behing the 2005 Mustang, hoping that sales of the Mustang will drive its passenger car sales as a whole.

Porsche fined U.S.$7.9 million for failing to meet Corporate Average Fuel Economy limits

Washington, D.C. -The U.S. National Highway Traffic Safety Administration (NHTSA) announced civil penalties against Porsche and Ferrari totalling over U.S.$9 million for failing to meet Corporate Average Fuel Economy (CAFE) limits.

Porsche was fined U.S.$7,896,025 for not meeting CAFE requirements in the 2002 and 2003 model years, and Ferrari Maserati North America was fined U.S.$1,139,710 for non-compliance in 2003.

General Motors paid a civil penalty of U.S.$1 million to settle charges that it failed to conduct a timely recall to correct a safety defect. The problem involved windshield wiper failure in 581,344 Trailblazers, Bravadas, Envoys and Isuzu Ascenders manufactured in 2002 and 2003.

Eh? I think that sucks for both cases. The idea of changing the color of your dashboard isn't exactly that original or innovative. Heck, my stereo faceplate can change colors (it's on purple at the moment). As for Porsche, why are they just being fined now? The law went into effect back when the Arab oil embargo stuff was just starting, mid-70's or so. Apparently, the average MPG of their cars needs to be 27.5? How's a sports car sompany supposed to do that?

Well I'd rather Porsche and Ferrari concentrated more of their time developing new faster, better handling cars than making the existing model engines more fuel efficient. If you've got enough money to buy a Ferrari, you have the money to spend on fuel.
 
I think what Ford should do is continue to sell Mustangs with the color changing thingy, but lock it (like the locked cars in GT3) until this lawsuit clears over, then re-enable it.

I hope you're not the only one who's annoyed - but you're definitely the only one who's taking it seriously.

By the way, I do hate Porsche. Wow, a quick car than handles well. Those are rare.

Actually I didn't tell you this but I also want a 928 GTS - those things aren't kidding around. 93-95 only. Not on my 'near future' list though.
 
Those things are cool. V8, FR. Loads of power.
Get one in Yellow. They arn't as nice in any other color.

I can't recall the last time I saw a 928, so I'd bet these things are among the rarest of the 275 cars.

So...you hate Porsche, and Toyota. That leaves America. What are you a Chevy boy? A Ford guy? Or a Chrysler man? Or are they not good enough for you?

[Edit] Porsche is well known for great handling cars. As is the Testarossa, and many other high dollar sportscars. They're usually more geared towards handling than all-out speed anyway. [Edit]

Yeah - and I don't like it that much, which is why it's not a near future car. One day though - performance is rivaled only by a few cars on that list.

I have no brand biases and like on a car-by-car basis solely.
