From the looks of it's tail I think I see flukes so you're probably right. But if you don't notice that, it's pretty scary.

If you surf or bodyboard you know the difference - the dorsal fins are quite different, too - the dolphin fin is curved and rounded. The little buggers surf, too, which is what I think this one was doing.
 
I've seen a bunch of mackeral surfing before, it's quite funny that last little sight you see before your eyes are pummeled with water is usually of a few fish in perfectly parallel lines surfing through the waves that is about to pound you.

Little bastards, I wish I was that good.
 
If that was a pic of me and I thought it was a Shark you would see a lump and brown stain from the back of me on that pic.

If you were surfing in the Monterey area. Why you would I don't know, The water is damn cold. You would likely see a shark. The sea otters attract them. (Ohh, nuggets. YUM!!)

As far as soiling oneself: not the color of the water.
