I can't talk about this to anybody really because it's really personal, but on the internet, nobody knows me, nobody can point me out on the street, and i can say what i want here more easily than i can to somebody else. i feel that i must say this stuff because i got a heavy feeling and i need to let it all out...

...things went worse than the worst possible scenario...2 years ago, a close relative of mine was arrested because one of his employees had burnt down his business and blamed it on my relative. he was in canada at the time so that was completely impossible since the business was in El-Paso, Tx. The rcmp had sent him to the US just recently and the court hearing was yesterday. The max allowed time for Arson in Tx is 3 years i think. The judge said that because my relative is muslim, that he will be recieving beyond the max allowed time. "To teach US muslims a lesson." A family friend told us about a similar fate happening to a friend of theirs, i never believed it...now...it happens to my flesh and blood...and, i'm so mad right now because of it, i can't think or see straight. put simply, there was absolutely no proof that this relative had commited any crime, he was in ANOTHER COUNTRY at the time it happened and yet...he's being tried for a bogus charge and being given more than 3 years in jail BECAUSE HE'S MUSLIM. Now, we're trying to appeal to a different court, see if we can sue the judge for discrimination and refusing to provide a fair trial. but to do that, we need to find and be able to afford a lawyer that has the balls to defend an innocent muslim. fair trials...my ****in ass

a very close relative was just thrown in jail for BEYOND the maximum allowed time by the law for something that wasn't caused by him. the reason you ask? he's muslim - that's EXACTLY what the judge said.

come on...i'm sure ur gonna flame me for my anti-american views...BRING IT. i don't care anymore. it's not happening to you...you don't know **** about what's REALLY going on or the **** muslims in general going through. Did u know police are LEGALLY allowed to arrest muslims for no reason other than the fact that they're muslim? of course not...a country like america wouldn't have that now, would it?

I don't know why anyone would flame you for that, except for your last line, but I can cut you some slack because I'd be as angry as you are. If what you say is true, this judge is the anti-American, not you. I wish I could offer something more. But that's it. Given the facts you provided, you are right and the judge is wrong. If the facts line up you should have no problem getting an appeal.

I also want to add that trials are based on proof. The truth doesn't matter if it can't be proven in court.
 
this hasn't been done just to my relative...it's happened MANY times to MANY muslims around america...

it's also putting our canadian immigration status in jeopardy
 
If it's true,... and you can PROVE thats EXACTLY what the judge said,... you should make national headlines. I'd be on the phone to every radio station, news paper, and TV Studio within 500 miles....

........ justice is blind,... what a bunch of friggin horse crap. Same goes with the jerk-off who got booted for not takin down the 10 commandments,.... jerk-off.

umm...no, u CAN'T make headlines. the media won't cover this since it's been going on since 9/11...every muslim is affected by this no matter the court. it's just nobody can afford to challenge the judges that make these statements. we, are going to make an attempt at it because our lawyer @ least has SOME balls to defend a muslim. Most lawyers charge double or won't accept muslims at all because it's bad for them since muslims will almost always lose the trial...it's a sad fact of life.

I'm sure the very same thing happened to people of russian background back in the cold war, the very same happened to the japanese in wwii (except they had 'internment camps'). constitution in the us applies only to non-muslims right now...its really REALLY bad.

9/11 or not bro,.. if your a citizen,.. your protected by the constitution. I'm no lawyer, but common sence tells you that there is supposed to be a seperation of church and state, ya know, justice is blind to religon.....

.....on top of that,.. the crime wasnt religiously motivated.


You need to go to the press if what your saying is true and if you really do have inrefutable proof. Plain and simple,... drop the lawyer you have now, cause as soon as word gets out about what happened, you'll have lawyers knocking down your door.... many will probably do it for free considering the circumstances.

In all seriousness,... you do have a case,.. common sence says so....

Do something about it or stop complaining. Maybe youcould go to a better country. What do you want anyone to say? Yes it's wrong. No there's nothing anyone here can do to helpbesides make suggestions, which you shoot down immediately.
 
i'm sorry...it's just...i havent seen the person in 2 years, and he's looking @ another 3. it's hard for me... all i can do is pray it'll all blow over. we're doing whatever we can but it's not easy - or cheap. especially when you live 2000 miles away, in another country from where this is all happening...

That is about as backwards as it can get.

I have to say that on the face of it, I don't believe what you are saying. I don't think it is happening in America. If it is, you have a huge case that will make national headlines. I think something is being misinterpreted and you are too quick to decide that it is racially related. I don't know all the facts, but if what you say is true, every defense attorney in the country would want to defend your relative and every media outlet in the country would want the story.

If what your facts are totally straight, then you are holding yourself back. This is America, I know that you don't understand the way it works, but our media isn't against you. The reason? Money. The reason lawyers are all for you? Money.

By the way, most lawyers are required by thier firms to take on pro bono cases (free) for charity. And lawyers love it when they can uncover racism.

If your facts are straight, this judge put his a*s on the line when he knows the law damn well. If your facts are straight, then you really aught to pay more attention to the things us Americans write on this website, because they will tell you exactly why here in America you can win that case.
 
it was recorded on the notes that are taken during the trial. that's why we're trying to sue the judge...might be trying to get other people together. this isn't the first time it's happened. (in the other cases both money and race were issues for not following up on what happened)

As i said, there have been MANY changes in the past year. Canada for example, after being pushed greatly by the us, has passed laws where arabs/muslims can be arrested and detained indefinately for "looking" suspicious...

either way, the next appeal probably won't happen for another year considering the wait we had for this first one...not to mention another 10-15k in lawyer fees. our family is pulling every string possible to get enough to cover the fees and to keep living. We're calling in every favour we can, it's all a matter of time.

i'd also like to add, that the arsonist - a non-muslim, walked after 3 months though all evidence submitted pointed to him commiting the crime...

Somehow I dont believe thats exactly what was said. If it was, you could create enough political preasure to force the appeal to happen sooner....
 
everything said in a courtoom is documented. we're pressing charges for what he said or at least appealing for a retrial. not sure still about press. my parent's won't listen to me on this stuff. i had to reeally push them to tell me even this much of what happened

We all know that every word in court it written down.

Trust us dude,... if you have the proof you say you do,.. we'll be watching you tell your story on Larry King Live next week....

So this is all hearsay from your parents... and they probably got it hearsay from someone else. Your information may have fallen victim to someone else being too eager to point to racism.
 
umm...no...not for someone this close to me. this isn't second hand info, this is directly from the lawyer THEY hired...
 
I have known you for a fair while eMad, and I talk to you quite alot. You are not a man who lies, especially in big doses like this. Also, the American Justice System is far from perfect, and believe it or not people, racism is still rife. More so, after 9/11. Now I know I'm not American, nor do I live there, but it's a general fact. But this is not about anything to do with Politics or the Justice System. This is in defence of eMad.

eMad is a credible guy, and what has happened here is a big injustice. But in light of all things said, today is eMad's Birthday. He's happy at the moment, so in all fairness...

exactly 1 year after I made this thread... I find out that my dad is going onto bail starting tomorrow for his upcoming trials for his immigration status :D. I'm glad the FBI actually helped out for this case - there was just too much that went wrong last year for them to ignore it.

So, for the first time in nearly 5 years, my daddy's comin home :D:D:D.
 
ugh, i just read some of the stuff I wrote... I forgot how big an ass I used to be :scared:

Anyways, sorry for the offensive comments I made - I didn't *really* mean to be that rude/offensive. It's just that I was hurt really badly by the stuff that happened to my dad... and well... you get the idea.

4 or 5 years ago, the manager (and also a close friend of my dad) at my dad's business in texas decided to set the building on fire. He later got arrested and somehow convinced my dad that he was innocent of what he was being charged with. We believed it and helped pay his legal fees and the whole 9 yards to go with it. Later on, we found out that he pitted all the blame on my father by saying he was only an employee and just following the boss's orders. If you consider the size of the investment and the amount of time my dad put into getting that truck stop/hotel/trailer park area up and running, there was no way he'd order something like that. That business was what he had been aiming to achieve for a very long time and he finally got it.

Roughly at the same time as that, the RCMP came knocking at our front door about this *not entirely legal but not entirely illegal* side business my dad had. He used to be an agent for a friend in pakistan and helped do a money exchange thing like Western Union. The not so good part about that was that not all of the money came from legitimate sources. Whether he did this knowingly or unknowingly, I'm not too sure, but whatever the case, he somehow got wrapped up in a money laundering case. The canadian judge sentenced him to 3 years for that.

Once his canadian sentence was over, the US immediately demanded custody of my father because of what happened in Texas. The canadians obliged and sent him down. They held him there for nearly a year while waiting for a court date - they were holding the trial out in some county in the middle of nowhere. Most of that time waiting for the trial was looking for a lawyer willing to take a case for a muslim stuck in the middle of nowhere - seriously, few wanted to come that far out, and fewer still wanted to help a Muslim for any amount of money.

Anyways, when the trial happened (my birthday last year), the judge said something along the lines of "Normally, I'd only give you a 1 year sentence but I'm going to give you the maximum 3 years to teach you muslims a lesson." The lawyer was outraged, he did his best but that wasn't going to help much. As i said earlier, nobody was willing to help... and then somehow, my dad and the lawyer managed to get some people in the FBI to take interest in this. When the FBI investigated, they found that all the court documents were tampered with and there was no reference of that racial slur by the judge in there. Anyways, it took them the better part of 6 months to fix that up and let him go. Oddly enough, despite all their help, they refused to compensate for the harm they caused and the unjust trial...

They finally sent him back to Canada a few months ago to await his immigration trial. It takes 3-4 years of living in canada to gain citizenship and you're not allowed out of the country for more than 3 months at a time during that time frame. So yesterday was the immigration hearing and they said they'll be deporting him on tuesday... but the lawyer fought to give him bail until then so he can transfer the title to the family business and everything else over to my brother. In the meanwhile, our immigration lawyer is trying to figure out a way to convince them to allow my dad to stay in Canada. Soooo... all we can do now, is hope things go well on monday.
