Pako, as I don't really know exactly what the duties of a moderator are, I would assume that they are sort of like a manager at a place of work.?. So in light of that, I am going to have to respectfully disagree with you on this one. There are many things that a moderator could do.
I interperate the AUP as a general "guideline" to be looked at by a moderator. In my opinion a post should not be looked at wether or not it strictly follows or does not follow the AUP. I don't think that it sould be so clerly defined as a "yes" or "no." There is certainly room for moderators to use there best judgement in regards to what a post contains. A moderator could determine on there own if content in a post is deemed acceptable or unacceptabe regardless if it strictly follows the AUP.
Then the moderator could use any means necessary to convey their point to the member or members in question.
Does it have to be a documented statement by PM. Not necessaraly, some times a gentle prod in a post can be very effective. And if it proves ineffective then the next course of action should be take. Progressive discipline. I have seen it done, I use it at my job, and it generally works quite well.
I find it hard to imagine that a moderators hands are tied as I don't think that Jordan would set such strict rules on his staff of moderators. But, I could be totally wrong.
What would be great is if each member posting understood what "Are you getting ready to post a degrading, harsh, or downright stupid comment?" means to a mature person. Perhaps some educating should be done to help those of a lower maturity level to understand what that comment means.
Yes, this would be great if everyone understood what that statement means. However, not everyone does or they don't heed it's message. This is where the moderator should step in to help "educate" the member or members in question. IMO, it is the moderators responsability to take this action. To make sure that the members fully understand the rules.
Please note: I have a very vague understanding of the responsabilities of moderators, so if my statements are inaccurate, please forgive me.

On that note, maybe the moderators responsabilities should be know to all so that members would know what to expect of them and how to act accordingly.?.
