I got my second ticket about this!!!

Are my neons blue?

Alright guys, I need your honest opinion... I am am give you some facts and a couple pictures... and you can be the jury...

Here it goes... the ticket concerns my neons. They are teal. Here in florida, neons are illeagl as long as they are not blue, or red. The law states, and i quote.

(1) No person shall drive or move or cause to be moved any vehicle or equipment upon any highway within this state with any lamp or device thereon showing or displaying a red or blue light visible from directly in front thereof except for certain vehicles hereinafter provided.

then it goes on to say cops can have such lights... this is taken from this site: www.leg.state.fl.us look up Statute 316.2397

In both cases... (like i said this has happened before) the cop said that any shade of blue was illeagl, therefore making teal illeagl. In my opinion, there is nothing about any shade of in the law... it states red, or blue. In this latest case, the cop said "purple is fine..." my question is, isn't violet a dark shade of blue? Its on the blue scale, right along with teal. Also, what about orange, isn't that a combination of red and yellow? Orange is also fine...

I am going to court over this... and i will win... I just wanted your opinion. take a look at the photos... and let me know!!! thanks!!

my truck is greenish teal during the day, a blueish teal at night... these pics aren't the greatest, but are the most honest about my neon light... the light is almost dead on the color!!
 
Take a few daytime pictures, and pic the ones that look the least blue. Take those to court with you. Your argument lies in that the laws seeming intention is to avoid confusion between neon lights and lighting on emergency vehicles.
Use the word "Green" when referring to your lights. If asked directly, say that the technical name is teal.
Here's the part that will sink you if the judge feels like it:
."(2) It is expressly prohibited for any vehicle or equipment, except police vehicles, to show or display blue lights. However, vehicles owned, operated, or leased by the Department of Corrections may show or display blue lights when responding to emergencies. "
That's a pretty broad stroke, that doesn't really cover specifics, mostly used for "blanketing" a law that is particularly difficult to nail down. Especially broad in conjunction with this:
316.241 Selling or using lamps or equipment.--
(1) No person shall have for sale, sell or offer for sale for use upon or as a part of the equipment of a motor vehicle, trailer, semitrailer, or pole trailer or use upon any such vehicle any headlamp, auxiliary or fog lamp, rear lamp, signal lamp, or reflector, which reflector is required hereunder, or parts of any of the foregoing, which tend to change the original design or performance, unless of a type which has been submitted to the department and approved. The foregoing provisions of this section shall not apply to equipment in actual use when this section is adopted or replacement parts therefor.
(2) No person shall have for sale, sell, or offer for sale for use upon or as a part of the equipment of a motor vehicle, trailer, semitrailer, or pole trailer any lamp or device mentioned in this section which has been approved by the department unless such lamp or device bears thereon the trademark or name under which it is approved so as to be legible when installed.
(3) No person shall use upon any motor vehicle, trailer, semitrailer, or pole trailer any lamps mentioned in this section unless said lamps are mounted, adjusted, and aimed in accordance with instructions of the department.
(4) A violation of this section is a noncriminal traffic infraction, punishable as a nonmoving violation as provided in chapter 318.
 
i have green pictures... i decided to post the true ones here... its amazing what using the flash does to the color of the lamps... i use those in court, used them last time, will use them again.

no opinion on it tom?
 
I've never seen neons on a car/truck before as it is probably against the law in this country. But looking at the pictures it's hard to say for sure what color it is. If you hadn't told me they were teal I would have said they were light blue. But don't cops have normal - dark blue lights and don't they flash. I think you got unlucky on both occasions with a$$hole cops that just wanted to fill their quota of tickets for the day. I know you probably don't wanna hear this but if this keeps happening wouldn't it be better to change the color of your neons? Even if you win the court case there's no reason why you wouldn't get stopped and given more tickets. What ever you decide good luck!
 
this is a thought that has crossed my mind... but i like the look of the set up i have right now... the lights match my truck exactly... the pics show my truck as being blue, but it isn't... i will be taking day pics soon, and i will post those as well...

it would cost about 180.00 to replace them... its 48.00 per tkt. i don't know... we will see...

Yep, that's blue. Personally, I don't even tempt the Law. Don't give them a chance to question your legality.

Sorry mate - VERY blue in the photos.

I imagine anything even close to blue would be pretty touch.

Arguing blue v teal with a cop would be like arguing more than half the car on the correct side of double lines meant you were legal - distinct lack of interest...

If it comes down to arguing semantics over colours, I don't fancy your chances.

I agree, purpose of the law is to distinguish between emergency vehicles and others? How many emergency vehicles have lights under the vehicle? how many are pickups? I think it is an unfair ticket. But as one of the earlier posts says, it will probably happen again, so change the color... You say $48 per ticket vs. $150 to change lights? What if you forget or loose your license on the next occassion of being stopped? What if you had one beer? What if your friend has a high-powered fully automatic weapon on his lap? If it wasn't for that teal light... btw, I believe teal is a modifying color description that can be added to either blue (teal blue) or green (teal green). Similar to violet, there is red violet and blue violet.

I will be posting the pictures I will be using in court, here tonight.... I forgot to do it last night, I got involved with the qualifing....

I value all your opinions, and comments. But i think i am keeping them... I have falling in love with them to much to change them, been on my truck for two years now... I think I can handle 1 tkt per year!! :D

Sorry Magic, they look very blue to me in those nighttime shots...if they look more green in the day, use those photos. I don't think the judge is going to be easily swayed, tho....not when there's money in it for the state. ;)
