If so, considering they already admitted he was deported in error, if they fail to convict I really don't see any legal basis for deporting him again. I can't see Noem letting him stay or get anything beneficial from this.
I don't believe the order has been vacated but I can see him being deported anyway. The protection order was granted by an immigration judge serving the DOJ, as immigration courts do (they're not actual courts of law, which is why immigration warrants can't be enforced to the extent that judicial warrants can; they don't grant access to private property, for example), and was never challenged because the DOJ didn't see him as a threat. The only evidence against him was a report of an altercation involving law enforcement over loitering outside a Home Depot, though Kilmar Abrego Garcia wasn't named in the police report for that incident, and the statement of a confidential informant submitted to immigration officials by a cop that was suspended at the time, and ultimately removed from the force, for providing a prostitute with information in exchange for sexual favors.Is the withholding of removal order still in effect? If they can't prove he's part of MS-13 or a danger to the country, I don't see the Supreme Court allowing him to be deported again. Not that I put it past this administration to try, but clearly the courts have some power if Abrego Garcia is being returned in the first place.
