It depends on the state. But you're stupid if you don't. My brother in law was struck broadside at 50 mph by a driver who blew a red light while talking on the phone. He almost died and was in a coma for two weeks. He didn't recognize my sister when he woke up. Aside from a limp and some nasty burn/graft scars all over his body, I guess he's okay.
