That's the whole point - if he'd stopped at the Stop sign, and looked, he would probably have seen the biker. As a direct consequence of his failing to obey the stop sign, a man has died.

He didn't intend killing the biker - hence the charge of manslaughter, rather than murder.

And this is my point - he made a mistake running the stop sign, plain and simple. If it had been his first offense, how would you have seen it? Imagine - the guy's never had a traffic offense in his life, dedicated his life to public service, and one day in rural South Dakota he's late for something, so he runs a stop sign and kills somebody. It's a mistake - a big one - but that's how I originally heard of it. You think CNN would have the decency to tell me he'd had all sorts of tickets, but no.

He'd get manslaughter either way - highest you can get doing it with a car is 'vehicular homicide' which would be similar to maybe murder in the second degree considering punishment - still could carry life in jail. Manslaughter-two can't.

I certainly don't think he should be let off, and my original post was made before I knew of his extensive record - my point was that a mistake in an otherwise clean life shouldn't carry the kind of consequences everybody knows are unavoidable. Kobe Bryant is a fair example and he hasn't even been tried yet. If he had a job in which he could be sufficiently replaced, he'd have been fired by now.

Well, as I mentioned above, the charge should still stand - the circumstances you mentioned above are certainly relevant for consideration of sentencing.

At the end of the day, a man died as a result of an illegal act. It doesn't matter if it was the Pope or Hitler at the wheel, justice needs to be done.

Agreed.

Meaning that someone with a clean slate shouldn't have the proverbial "book" thrown at them.

fwiw, i don't give a **** about chris bangle, it's the cars that i care about. the rears on them look like ****, the fronts i can handle, they're new and original. the trunks all look like an 81 sinatra imperial.

In the UK, there's a charge called "Causing Death by Dangerous Driving", which sounds remarkably appropriate for this scenario.

Doug, I can't believe you're considering defending this guy. You ask if we should be allowed one mistake: ask the biker! Perhaps the biker's mistake was forgetting to put his helmet on. Did he get a second chance?

Speeding isn't a mistake, it's a deliberate act. However, that's not the problem here. The problem is that he ran a stop light. That's not a mistake, it's simply not acceptable. A mistake is having an accident because you were travelling too fast, not because you ran a stop light.

An example needs to be made.

First, we'll out mayorbill back on the ignore list. In my short time here, I've yet to see anything worthwhile come out of him. You've tried multiple times to pull this thread off topic, much like many other threads.

Now back to the topic.

Speeding is one thing (70-75 in a 50 zone). Blowing a stop sign is another. Blowing through a stop sign at 70mph? If the guy had at least slowed down he would have missed the biker.

Service to country and state means something, but this guy has shown a continuous pattern of excessive speed. It was only a matter of time until he caused a major accident. So they may take his civil duties into consideration, but he still took a man's life.

The helmet issue. To quote Jerry Seinfeld "When you jump out of a plane, you're not wearing a helmet. It's wearing you." The motorcyclist was hit by an SUV moving at 70 mph. He could have been wearing full body armor and it wouldn't have helped. A biker friend once said "At that speed, the only difference is an open or closed casket."

Does anybody remember the "Ehime Maru" boat? It was a Japanese fishing vessel carrying a group of school children on an exploration. The USS Greenville was demonstrating an emergency surfacing technique and collided with the boat. A 499 ton boat hit by a 6900 ton submarine moving at near top speed. The Sub got a few scratches and the Boat was destroyed. So...a 4400 lb vehicle hits 200 lb person. Yep, that helmet sure was a major issue.

Do I think this guy should go to Jail? Yes, he should serve time. I also believe that if they take his serivce record into account, they should also take his driving record into account.

You're supposed to stop at the stop sign because if you don't you might kill someone, or get killed. Death is implied from the outset. In fact, all traffic laws are designed to protect life. If you flagrantly dismiss them, you are saying more than "I'm in a hurry". And if you have a history of it, and have been let off over and over, finally achieving the worst case scenario should be plenty to throw the book at him. Now I only wish Bush would do this in Texas in his pick-up.

Uh, how do you miss a stop sign at even 55mph? I mean, it's one thing if the sign was dismantled or hidden, but that wasn't the case.

Second-degree manslaughter is a fairly weak sentence for hardened criminals and "perfect citizens" alike. It's usually anything from 1 year in jail to probation in most states. I'm sure he'll get probation.

He got his "one mistake" by getting such a light sentence.

Excuse me. YOU are saying that I am not an expert, and that I should leave automotive styling criticism to some expert critic? No, that isn't the way it works. Everyone is entitled to an opinion, but movie critics do not sway my judgement of movies any, neither would expert car critics.

Anyhow, I was just giving you a little **** over liking the new BMWs that most people think are ugly, me included. Just like people bug me about liking AMC and, as you seem to think, Sunbirds. Just to me, you don't seem to be taking it as a joke very well.

Seriously though, don't include me in the 15 year old BMW fanboy who doesn't like the new cars and wishes they made the old light 1987 M3 or whatever the hell it is. I don't like most BMWs to begin with, they're not my cars.

You could look at it from a different angle. if this guy goes to jail, and he should, he won't be blowing thru anymore stop signs. As for speeding on roads, I'll be the first to raise my hand if asked if I speed. Yes, but only on the freeway. When you start adding street lights, stopsigns and pedestrians to the mix, your crazy to speed.
 
I think he should go to jail, go directly to jail, do not pass GO, do not collect $200. How is it possible to miss a stopsign? They are big and red. Also, I could be wrong, but I don't think it's illegal to not wear a helmet while motorcycling.

It depends on the state. But you're stupid if you don't. My brother in law was struck broadside at 50 mph by a driver who blew a red light while talking on the phone. He almost died and was in a coma for two weeks. He didn't recognize my sister when he woke up. Aside from a limp and some nasty burn/graft scars all over his body, I guess he's okay. I actually think motorcycles are stupid, in general. I'd never get on one again.
 
Maybe a one mistake on something a lot less dangerous. But he did kill the man. Maybe on something like a minor speeding or sumthing

Driving 55 it's hard to see country stop signs - even at 45 it's hard - Iowa and Nebraska have had so many deaths that they did a study and found if you weren't looking for it it wouldn't be easy to see. They began erecting 'stop ahead' signs out in the country at something of a considerable cost - I guess it cut down the number of deaths. 70 MPH is pretty hard when you're looking ahead not to the side of the road.
 
ok, i dont care who he is, if he broke the law, nail his a$$. I hate when people get off because they are "better than others". Hes a human like everyone else. He should get the same d@mn punishment any other bum would get.
