The FINA F1 GTR's are BMW backed teams, PD would still need McLarens permission to use the car without any legal problems, but there it's probably a car that isn't covered in any exclusive McLaren licence like all the others are, with that car in particular being owned and run by BMW, and in the GT racing itself, that team is called the BMW McLaren GTR, unlike the rest of them.
