I don't know what it is, but there's definitely some mileage in the idea that the angle/speed you go over some kerbs counts. The last time Le Mans was an FIA race I was watching @Tidgney and he was getting penalties on some laps and not others and genuinely couldn't figure out why.
Yup, there's 2 things with this;
1) It's angles, so like at redbull ring where if your 2 left wheels go out on turn 1 first you don't get a penalty vs if you're right wheel goes out with your left you do, you have to be really careful. The only thing I can think of with this (I don't personally get the wheel count thing) is the game thinks you're on a straight if your left wheels go out where as if you fully go out with your right wheels it sees it as a corner.
2) It's about advantage gain, Kaz has talked about this a little in the past. So I got 1 at Le Mans in the IGTL World Series because I nailed the corner but because I had slipstream on the exit the game thought I gained an advantage as I was carrying more speed. Penalties (From memory) are calculated with the A.I. in mind and what they do. Was in an interview awhile ago I believe, so if I had let off instead on that chicane for example I wouldn't have got one.
I would argue the penalty system is to complicated to this extent, but there's lots of little quirks. It can also definitely be abused.
