That is certainly your prerogative. However, I honestly don't see how that could be the Duke Dynamics kit. I mean, let me quote the comparison below:

I really doubt that. Lots of cars have one off customization done by PG themselves, and if people get confused if it's an option or not for the real car, I doubt it'll matter to anyone.
There was also a XJ220S that showed its foglights in an event tile during the earliest preview of the Festival Playlist, only to be replaced by a "normal" XJ220 in the latest Let's Go. @TheAdmiester may be able to confirm whether or not the standard XJ220 has any new body parts, but I remember some Youtuber saying the TWR bodykit is not a modification for the XJ220 - meaning that it's a separate car, which however is not currently in the game.That is certainly your prerogative. Now, what it could be, is another kit you can apply to the base Huracan, to make it look like an Evo. However, from a licensing standpoint, would Lamborghini allow that? I'm pretty sure they don't offer "Evo" conversions for their base Huracans and, since racing games are also used for advertising, this could lead to people thinking there are new options soon to be available for their cars, when in reality not.
I honestly don't know what is going on behind the scenes, but we live in the age of "We'll patch it later". I wouldn't be surprised if they're negotiating for brands and cars, all the way to the day people get their hands on it. Models ready and waiting to be deployed. And it's because they're still negotiating, that they won't confirm the absence of these pending brands.
Generally speaking, it seems that parts giving a model the appearance of a more recent facelift / a higher-end trim are a big no-no. Manufacturers are probably fine with players being able to turn a car into its older and cheaper self, but would be rather peeved at the implication that, say, all the difference between a Huracan and a Huracan Evo is a front bumper.

It’s one thing to resemble, it’s another thing to 100% copy. Considering we don’t know either way I think both cards can be on the table. We’ve seen cars being able to use base trims of kits that aren’t offered on their higher end models, we’ve also seen generations of cars using the next generations kits as well, like the 1st gen RSX getting the bumperS from the completely redone RSX that no longer have the lumps on the headlight/taillights. It’s not unheard of.
This is true, but we should also note that Maserati's roster has been slaughtered (for lack of a better term) for FH5.
Actually, Maserati is not under the control of FCA Italy (which still exists as a Stellantis subsidiary) - it's a subsidiary of Stellantis. They even have separate offices in Modena, and their plant in Grugliasco is not part of FCA's supply system. Confusing, I know!
That's what I'm expecting too... But if the bodykit isn't there, the plot would thicken considerably.
This seems most likely, especially since the Toyota and Mitsubishi additions in FH4 proved that it's a guaranteed way to get people to come back in when interest in the game starts waning. I highly doubt they're going to just throw up their hands and say "fine, forget it then".
Oh, I don't doubt PGG's commitment to bringing any missing brand back into the game... But as they say, it takes two to tango. I'll keep my Lancia liveries ready for import, sure, but I'd rather avoid holding my breath, waiting for the day Fiats are back.
Another subtle clue would be the TWR window banner which is not present on the regular XJ220 and would lead me to believe that was an XJ220S that was prematurely featured.P.S. a detail that would help clear this mystery out is wheels. Had that XJ220S been wearing the proper multi-piece racing rims, we would've been able to exclude with some measure of certainty that it was just a bodykit.
