I'm dreading the fact I will have to go to court so much, but I suppose its worth it. I bet the kid ends up losing his license for a long time, but all of this doesn't seem like its going to teach the kid anything. In fact I'm going to invite him to join the Safe Racing Society, which is a local group around here that sponsors drag days and stuff.

I wasn't going to sue the parents but after meeting the dad they deserve it. Sure money doesn't make my knee feel better, but it will buy me my next car :lol:. Granted it won't be for a while because the courts here are so freakin slow.

As far as the knee it will be sometime this week since right now I can't walk. Kinda sucks but wheel chairs are fun as hell. Me and Chris have been trying to race with them but our females keep us from having any fun :lol:.

This is why we love you Joey :lol:.

A couple things.
  1. It's nice to know you are going to recover. I hope it will be a full recovery aswell.
  2. Just be thankful that the street racing was done in cars that are somewhat less solid than an F-150. That is probably the main reason for how "limited" your injuries are. In my area, street racing is mostly done by morons driving Camaros, which are rather more heavy than an SRT-4, and we have had quite a few serious accidents due mostly (I kid you not, literally roughly 7 times out of 10) to moronic parents buying their under-18 kids big V8 powered cars, who usually have the cars for literally a week before crashing them in a street race. Young kids should not be allowed to have cars with over 150 BHP unless they can, in fact, actually drive the things. Which sadly, is not usually the case.
  3. You shouldn't have to worry about him getting his license back for quite a while. I'm thinking 21 years of age.
On a more positive note, now you should be able to afford the next Camaro, should GM build it.

He said he worked at Chrysler and had absolutely no idea an SRT-4 was that powerful. Im 13, and I know better. Dumbass.
 
The dad asked me how fast we were traveling and I told him 80, which is not uncommon for Michigan freeways where the limit is 70 anyways. He was like well I believe you guys were speeding as well.

Even the cop didn't care we were doing 80 since like I said its not uncommon. They won't even stop you for 80...85 yes, but not 80.

The surgery is going to be on Wednesday for my knee, and I should be home on Friday.

It all depends how much I can get out of the parents and what my lawyer says, I have no idea about legal stuff.
 
on a side note, I understand in most serious crashes in the U.S. (and probably in the rest of the world) you have to sue, because if you don't the other party is sure to sue you.

I've had some friends in the States who have been involved in a crash and have had to sue before being sued, even if they were at fault or not.

It doesn't matter. My uncle owned a Chevy Silverado a couple of years ago. His house is on the side of a highway. One day, an old lady plowed into the side of the truck (which then demolished a room in his house) going 80+, and promptly sued him for the damages done to her car. All this sueing was done after it was determined by the police report that she hit the Silverado going "a speed in excess of eighty (80) miles-per-hour" whilst said truck was "parked eight (8) feet, nine (9) inches from the side of the shoulder, as determined by the traction-loss marks put out by the hit vehicles tires," to quote the police report. She didn't win, but the case wasn't thrown out of court either.

There's a big difference between 80mph cruising and 120mph racing.

Sounds like he's trying to come up with some excuse as to how you can be blamed for this. Better get that lawsuit moving quick, or else this jackass will probably send one your way.

I didn't even catch that. The ass is trolling, trying to find something he can bring up in court in case you sue him that detracts from your case. Be sure to mention next time you see him how his dumb ass son was going "55 over the limit" vs. "5-ish over the limit" and "into the sides of trucks while being outrun by cars with 70 less BHP" instead of "cruising down the highway."
 
Blazin...make sure you take heed to what I warned you about.

Don't just be hastey when it comes to operations like extensive knee surgery. Do tons of research and get the best doctor you can find. Find out how many successful operations the surgeons have done.
 
I'm fairly young, but I don't think I've ever driven a car faster than 80mph, so in some ways I'd feel bad for the kid (you said you almost cried when you heard you couldn't drive for 2 months, the kid won't be able to drive for 3 years-life if paralasys), but then again, he deserves every ounce of what he'll get. There is no sense in driving that fast, regardless of the car or conditions on a motorway (this is winter we're talking about, winter).

Blazin, depending on how fast you got the paperwork settled on your cheaply-aquired sleds, you should also get a pretty penny for them from the insurance people. $$$

Get better quick dood.
 
Uve done one thing Blazin', uve proved Clarkson is one bull asshole for ridiculing Ford Pick-ups, sounds like w/out that roll-bar ude have more to focus on then that busted knee and suing the pants off the dodgem.

So why would he sue the parents over a car that was more powerful than he suspected?

I know Blazin' isn't dumb enough to do that.

But I had a feeling he would say you were speeding too.
You should have told him "But who was the person who was racing?"

If you told the guy you plan to sue, I'm more than 100% positive he's going to file his own lawsuit against you. He wont have much of a defense with, "The plaintiff caused the accident because my son couldn't judge the flow of traffic properly because the plaintiff was speeding." But, that wont stop them from using this defense in court. Trust me, they'll stoop to this level.

Don't talk to this guy anymore. Watch out for anyone else asking questions about the accident. Don't answer any questions they ask you. They're setting you up for a lawsuit. So, keep quite, and don't say anything more to anyone. Lawyers love to hang out at hospitals and snoop for info even though they aren't allowed to.
 
Good to hear from you Joey. Sounds like you're coping well. :)

I don't know much about suing in the States etc, so can't offer any advice (Solid Lifters sounds like he knows what he's talkin' about), but good luck with the surgery on the knee (sounds like it's in a really bad way) and with everything that is to follow. If you can get that kid into your anti-racing group that would be good - hearing the message from a paralysed peer rather than an adult tends to hit home a bit more. 👍

Hope you make a full recovery dude, and stick with the physio afterwards - it's worth it in the longrun. :)
 
Me and the un-official, as of yet non-existent GSX-R/4 Fan Club are glad to see you well, Joey. And by well, I mean alive and typing.

As a veteran of car accidents (the car in which I was an occupant has been rear-ended THREE times in my life, but no accidents yet as a driver, phew), I understand (sort of) the suck you've got now.

And you should sue like hell.

The doctor doing my knee surgery is the same guy I've gone to for years about my knee (I've always had bad knees), so I trust that he will do a good job.

But the kid in the SRT-4 passed us on ths shoulder of the road, the left shoulder to be exact. So there is such a little case it's not even funny. Plus the old couple that stopped called me today to see how I was feeling. They told me to let them know about the court dates and they will be there to be witnesses. Two people that I don't know helping me is good.

My insurence company is not going to believe the sleds. It'll be funny trying to explain that to them. But I'm pissed that I lost them, I didn't even get a chance to ride it.

But I'm sueing based on damages, medical bills, and for my frustration that I have to be in the hospital for a week.

I don't think you got what I was saying (I was a bit unclear).

The dad said he had no clue the SRT-4 was capable of doing 120, and he works at Chrysler supposedly. Either way, if he does work at Chrysler, I think Blazin might be in for a nice bag of change.
