Actually, I'm wondering what would happen if you really do find an empty case? Do you get a replacement? If that's the case, what's to stop people from taking the disc out and going back to the shop to ask for a second disc? There is no way to prove that there was a disc in the case to begin with.

Most shops here dont put the disc in the boxes on the shelf. They have all the discs behind the counter and only put them back in the box in front of you once you,ve bought it.
Even for new games? They open the cellophane, and remove the disk? Seems strange, and at least here in America it would be illegal for a retailer to sell a game as new in that case. As soon as the cellophane is removed, it is no longer a new game.

The answer is simple shake the case. If it rattles then its there, if its doesn't, DON'T BUY IT!
All PS3 cases are sealed. How could they be empty?

Gamestop does it here in NJ. They open one game to put the case for display. They normally won't sell it to you unless it's the absolute last copy. Even then the one I go to knocks like $5 off the price. I don't know if that is common practice or not .
